If I am HIV positive and going to work in a restaurant, what am I required by law to disclose? _________________ Cheery-Cheri, just happy to be here! |

For Americans, the ADA (Americans with Disabilities Act) protects your privacy completely. HIV infection is covered by this Act.
An employer may not ask or require a job applicant to take a medical examination before making a job offer. It cannot make any pre-employment inquiry about a disability or the nature or severity of a disability. An employer may, however, ask questions about the ability to perform specific job functions and may, with certain limitations, ask an individual with a disability to describe or demonstrate how s/he would perform these functions. ~ADA _________________ Life is what we make it, always has been, always will be. ~Grandma Moses |

*nods* the issue is that, unfortunately, HIV/AIDS is still something that is hard to disclose without ramifications; in other words, someone who were to share the information usually ends up very quickly being cited for "performance issues" that are made up and fired despite the fact that it is not legal for it to happen |

Thanks for the feedback and information. I have just been uncertain, especially being in the food service industry. I appreciate your time!

| I think you will not run across really many jobs that would even be interested in that information. Being in the food industry the standard precautions that you are suppose to follow for health and safety reasons are also what is recommended to prevent spread of a virus such as HIV therefore as long as one is following the guidelines there should be no reason anyone would need to know. |

| I don’t think that working in a food service will even infect anybody because you aren’t having sex with anybody or donating some bloods. I’m sure that this will never be an issue to your employer. |

| I dont think is a requirement, when working in a food related environment, to disclose medical information of this kind. |

I also don't think you should disclose anything.
As long as you know you are infected, you should take the steps to make sure that you do not spread the virus. In the food industry, as long as you follow standard regulations, you should be fine. |

This is true as long as secondary infections, like hepatitis, don't develop. Many outbreaks of hepatitis are traced to food handlers. |
