If you go to a hospital for a routine check up or to have test done and they withdraw blood from you. Do they automatically test your blood for HIV? Or must you request that?

In some states in the United States, when you are pregnant, they perform an HIV test without informing you. In my country, you are required to get the person's consent before performing a test.

(b) when in the judgment of the physician, such testing is medically indicated to provide appropriate diagnosis and treatment to the subject of the test, provided that the subject of the test has otherwise provided his or her consent to such physician for medical treatment. 410 ILCS 305/8."


All health workers are required to get consent from a patient before testing for HIV virus but there are exceptions. You might want to check your state's policy on this if it concerns you.

I think for major things such as organ transplants etc that it is a mandatory test for eligibility reasons but not sure what else would be a mandatory testing.

I think that when they test blood for anything, they should automatically do a test for HIV/AIDS. Why not do everything possible to inform and limit the spread of the virus?

I agree that it should at least be an option. Some people have personal reasons and would rather be tested anonymously and that is not necessarily a bad thing since there are prejudiced people. But on the other hand I do think it should be a little more freely offered.

It seems simple enough, doesn't it? But Democracy protects people's rights to privacy and there are laws that hold health workers to confidentiality.

Until there can be a guarantee the insurance companies and employers won't discriminate against people who test positive for HIV, mandatory testing should not exist.

The stigma is stlll too great to have the information automatically placed in anyone's medical records.

I agree with DigitalJohn and also with DianaR.
I think tests should be mandatory - but I don't trust insurance companies to delay judgment since their job is to protect the premiums collected.
