Are the couples who have tested positive for HIV allowed procreation (give birth to babies) legally?

Different states have adopted different views reagrding this issue and we are yet to arrive at a consensus with regard to it.

It's true that there are arguments on both sides of the coin and no answer can be taken as the correct one as of now.

What do you guys think? Views are invited.

Yes I think nowadays even mothers that are infected with HIV can give brith to children. The babies will not even carry the disease. They have to take preventative measures so the baby won't get infected with the disease.

Bodily fluids transfer from mother to child throughout the 9 months she is pregnant. She can choose not to breast feed if she wishes but the damage is so likely to occur it would be a very risky thing to attempt given the circumstances.

I think doctors are still quite unsure with this one and who has the right to deny a mother this but on te other side they have to consider the babies rights as well.

It's not actually the baby's rights but the unconceived baby's rights which is none at all.

I have a question. Does the child of two infected parents have a higher chance of being HIV infected over the child of one infected parent?

hmmm that's a good question Froix. I would think that since there are many ways to prevent a baby from contracting the infection it shouldn't matter if both or just one parent has the disease.

If I remember correctly, HIV will not pass onto the child while growing in the mother, it is during the process of birth that it may be passed on - thus why in some families an older child may be infected while a younger one may not be. But just remember, peadiatric HIV and full blown AIDS is not a pretty thing and I would not wish that heart ache on any parent if they were responsible for passing this to a child.

Well that answers my question. This would mean the man has no chance at all of infecting the baby.

I think with current technology and medication, it is now possible for HIV infected mothers to give birth to a non infected child. I'm not sure of the process of ensuring this but I've heard it is possible.

Not necessarily. The man does not directly infect the baby but if he is the cause of the mothers infection then he has indirectly caused the infection of the baby. And I would go so far as to say if he is aware of his infection and does not share it with the women then he has personally directly infected that baby.
